Content and context

Thomas Pearce alias Rossiter of Honiton, Devon, versus Mary Holmes and others. Walter Vye of Colyton, being seised in certain land in Colyton, on 30 August 1672 made his will, giving to the poor of Colyton and Sidbury and to his relatives and friends several legacies, and to the orator certain lands in Colyton. The will follows, the orator being the sole executor: witnesses, Peter Ticken, John Freeke. The will is disputed by Mary Holmes, sister of Walter Vye, Richard Perryam husband of Katherine sister of Walter Vye deceased, and William Marwood, son and heir of Katherine. The orator therefore prays for subpoena's to be directed to them. Power and authority is given to the defendants and witnesses to make affidavits. The defendants reply that Walter Vye died seised of the land, that they are entitled to it, that he was not of sound mind and memory when he made the will propounded by the orator. Certificate that the defendants' answers were taken on oath at Colyton 4 May 1673. Replication of the complainant. Certificate of appointment of a Commission to take answers to Interrogatories. Interrogatories to be administered to the Complainant's witnesses. Depositions of witnesses taken at Honiton, Devon, 8 September 1673: Peter Ticken of Colyton, Bernard Dwight of the same, John Freke of the same, Peter Ticken the younger of the same. Dated 18 October 1673 and signed by one of the Commissioners. An Inventory of the goods and chattels of Walter Vye taken 16 August 1672 is attached.
