Content and context

Whereas by Indenture dated 4 January 1733, reciting that a Marriage was intended between James Winstanley of Braunstone, Leicestershire, and Mary Prideaux, now Mary Winstanley, and also that by Indentures of Lease and Release dated 20 and 21 February 1710 [Doc 274] Samuel Reynardson of London and Mary his daughter in consideration of the marriage then intended between her and Edmond Prideaux, afterwards Sir Edmond Prideaux, Bt, conveyed several lands in the above parishes, freehold and copyhold, it was agreed that the lands in question after the marriage should be settled upon Mary Prideaux to the use of James Winstanley for life, with the remainder to the use of Mary Prideaux for life, with the remainder to the use of Phineas Cheek of Great Lincoln's Inn Fields, Simon Michell of Lincolns Inn, Samuel Chetham of Castleton, Rochdale, Lancashire, and Benjamin Trueman of Christ Church, Middlesex, and their heirs in trust for the younger sons and daughters of James Winstanley and Mary Prideaux, in default for the eldest or only son, in default as Mary Prideaux shall appoint, in default to her and her heirs for ever; and whereas the marriage has taken effect and Mary Winstanley has attained her majority; it is agreed that James Winstanley and Mary his wife shall levy a fine or fines sur conusance de droit come ceo to Phineas Cheeke and Simon Michell of the lands to the intent that a Recovery may be made for the trusts mentioned above; anyone in possession may lease the land;

and whereas Abraham Reynardson, son of Joseph Reynardson, stands trustee for the copyhold lands in the manors of Edgware and Kingsbury for Mary Winstanley; it is further agreed that they shall by Recovery or otherwise be conveyed to the use of James Winstanley for life, then to the use of Mary Winstanley for life, the to the use of Phineas Cheek, Simon Michell, Samuel Chetham and Benjamin Trueman and their heirs for ever in trust for the uses before mentioned as in the case of the Bedfordshire lands. Wutnesses: William Phellips, Lincoln's Inn, Richard Roberts, Writer at Mr Phellips. Four seals are attached.
